BELMONT — The Belmont Zoning Board of Appeals continued a contested administrative appeal over automobile repairs at 23 White Street to its October 5 meeting. Appellant Frank Valentino, represented by attorney Joseph Noon, argued the auto-repair use predated zoning changes and was never abandoned, submitting a letter from a prior owner's attorney, Richard Darcy. Inspector of Buildings Ara countered that water and electricity records showed usage equal to roughly two months of residential consumption over seven to eight years.
Town Counsel said "the person trying to establish that a nonconforming use is protected... always has the burden of proof." The board also approved special permits in six cases, including a two-story porch enclosure at 16-18 Watson Road for William Liang's wife's Parkinson's disease treatment, and continued a Winslow Road front-yard-parking request after neighbors said parked cars "looks terrible" and blocked sidewalk snow removal.
